Volunteer Terms and Conditions
On and from the date of submitting your online volunteer registration, you acknowledge that you have read and understood and agree to be bound by these Terms and Conditions. Volunteers can only submit a volunteer registration in their own name. Volunteers who provide incorrect, misleading or fraudulent information are ineligible to participate in the Event. Sport Projects (SP) reserves the right to request appropriate photo identification or other documentation in order to confirm a Volunteer’s identity, age and residential address (including confirming consent of a Volunteer’s parent or legal guardian where the Volunteer is under the age of 18) should it be deemed necessary.
The 2020 Cadel Evans Great Ocean Road Race (the Event) is supported by the State Government of Victoria (through Visit Victoria (ACN 611 725 270) (Visit Victoria)) and is organised, administered and managed by Sport Projects (ABN 63613291991). These Terms and Conditions are to be read in conjunction with any information contained under the Volunteer section on the Event website and within the volunteer registration process/platform (http://www.cadelevansgreatoceanroadrace.com.au/the-event/volunteers/).
For the purposes of these Terms and Conditions ‘Volunteer’ is a person accepted by SP as a volunteer in connection with the Event.
Obligations of Volunteer
On and from the date of submitting my application to SP to register as a Volunteer, I agree that the following terms and conditions apply:
Registering as a Volunteer is an acknowledgment of my interest in volunteering for the Event. I agree to be contacted by SP and being offered the opportunity to undertake activities as they become available. I acknowledge such opportunities may not arise and there is no guarantee that I will undertake any activities in conjunction with the Event.
I acknowledge the role of a Volunteer is an unpaid role and I undertake any associated activities at my discretion and based on my own personal choice. I acknowledge that any time and skill I provide to fulfill my role as a Volunteer is on a gratuitous basis and without remuneration, superannuation or any other payment or compensation.
I acknowledge that any Volunteer position or activities that I undertake will be by agreement between me and SP and not between me and Visit Victoria or the State of Victoria. I understand that I will be required to perform the duties and activities as specified and directed by SP from time to time. I agree to comply with any terms and conditions outlined in the SP Volunteer Guide as amended from time to time together with any other policies and procedures of SP.
I acknowledge that Visit Victoria (and the State of Victoria) and SP are independent entities responsible for their own actions and are not in any agency, partnership, joint venture or any other representative relationship. I understand that Visit Victoria (and the State of Victoria) are not responsible for the operations or conduct of the Event.
I agree to:
attend all Volunteer briefing sessions as required by SP;
attend all Volunteer shifts as allocated by SP, and inform the SP Workforce Team or my Event supervisor as soon as possible if I am unavailable due to illness, injury or extreme circumstances;
represent SP in a professional and courteous manner at all times;
undertake my tasks and duties as outlined to me, and follow the directions of my Event supervisor or a SP Event staff member;
seek assistance as needed from my Event supervisor or a SP Event staff member;
wear the Event uniform (including accreditation pass and lanyard) provided to me at all times while on duty in a neat and presentable manner;
drive (if requested to do so) an Event vehicle in a safe and responsible manner and in accordance with any laws and regulations upon satisfactorily completing the necessary vehicle paperwork as required by SP;
not incur any debt or pledge any credit on behalf of SP at any time without the approval of an authorised SP Event staff member; and
advise SP of any situation that is unsafe or not satisfactory, or any tasks that I feel I am unable or uncomfortable undertaking as part of my duties for the Event.
I understand that SP will use all reasonable endeavours to provide:
a safe and enjoyable environment in which to perform my tasks and duties;
briefings and supervision to enable me to carry out my duties as a Volunteer;
recognition of my status as a Volunteer, including (at SP’s discretion) benefits such as meals and uniforms depending on the nature of my Volunteer role; and
a mechanism to report any situations that I reasonably consider to be unsafe or unsatisfactory.
Release and Indemnity
I acknowledge and agree that I undertake my duties as a Volunteer at my own risk, that I am aware of the risks that are inherent in volunteering in connection with a road cycling event. I agree and acknowledge that the activities may involve a risk of personal injury and public liability. I agree to accept and mitigate such risk. I will be responsible for my own safety (and the safety of my property).
In consideration of SP allowing me to undertake the role of Volunteer, I agree that SP, Visit Victoria, the State of Victoria and its staff, contractors, agents and representatives will not be liable for my or any third party’s personal injury, death or damage to or loss of property resulting from my participation as a Volunteer.
I release SP, Visit Victoria, the State of Victoria and its staff, contractors, agents and representatives from all claims, losses, damages, liabilities, costs and expenses directly or indirectly incurred or suffered by me or any third party arising from or in connection with my role as Volunteer.
I further acknowledge and agree that I indemnify each of SP, Visit Victoria and the State of Victoria, and each of their officials, servants, representatives, agents and sponsors (and any of their respective representatives) against any claim, loss, damage, liability, cost and expense that may be incurred or sustained by SP, Visit Victoria, the State of Victoria and each of their officials, servants, representatives, agents, contractors, and sponsors (and any of their respective representatives) arising out of any act, matter or thing done, permitted or omitted to be done by me in relation to the Event.
If I am under the age of 18 as at the date of submitting my online volunteer registration, I acknowledge and agree that my parent/guardian has consented to my registration as a Volunteer and has provides a release and indemnity in the form set out above on my behalf. My parent/guardian further agrees and undertakes to SP, Visit Victoria and the State of Victoria on my behalf that the release and indemnity set out above applies with full force and effect to me and that any spouse, de facto spouse, partner or joint guardian will take no steps of any sort on my behalf that would result in the above release and indemnity being rendered inoperative, of no effect or being declared or ordered by a court as not applying to me. These Terms and Conditions will bind the Volunteer and any parent or legal guardian who gives their consent for Volunteers aged under 18 years of age.
The release and indemnity above (each a relevant commitment) is given by the Volunteer (or his or her parent/guardian as relevant), in favour of SP, Visit Victoria and the State of Victoria. It is acknowledged that: a) the relevant commitment is given by the Volunteer (or his or her parent/guardian) for the benefit of SP, Visit Victoria and the State and each of them with the intention that they are entitled to rely on and enforce the relevant commitment; b) the benefit of the relevant commitment is held by SP on its own behalf, by Visit Victoria on its own behalf and on behalf of the State of Victoria; and c) Visit Victoria may enforce and recover under the relevant commitment for and on behalf of the State of Victoria. I also acknowledge and agree that SP reserve all rights to supplement, amend or otherwise vary any and all of these Terms and Conditions, and any policies and procedures that affect my role as a Volunteer at any time and without notice. SP also reserve all rights to vary or change my responsibilities as a Volunteer or withdraw or revoke my appointment as a Volunteer at any time, without being required to provide reasons.
Privacy and confidential information
I acknowledge and agree that I may be photographed or filmed as a result of my involvement as a Volunteer for the Event and I consent to SP, Visit Victoria or the State of Victoria using my picture and likeness contained in any photographs or film for publicising the Event or for promotion of any future event organised by SP or Visit Victoria, or for promotion of Visit Victoria or the State of Victoria.
I acknowledge and agree that my contact details will be used by SP and Visit Victoria. Any correspondence sent from these entities would be restricted to future events, news, and promotions. These communications include the ability to opt-out.
I agree that if I do not wish to be contacted for any other reason other than to be provided with information about volunteering for a SP event, I will advise SP as appropriate by email to firstname.lastname@example.org.
Except as required by law, while performing my role as Volunteer and following termination or completion of my role as Volunteer, I agree I will not disclose or misuse any confidential information of SP or Visit Victoria, without the prior written consent of SP or Visit Victoria (as relevant). In handling and using confidential information of SP or Visit Victoria, I agree to:
take whatever measures are reasonably necessary to prevent the disclosure or misuse of the confidential information; and
use and reproduce confidential information only as directed and only for the purpose of performing my duties and activities as a Volunteer.
I acknowledge and agree that on termination or completion of my role as a Volunteer, or at the direction of SP or Visit Victoria, I will promptly return to SP or Visit Victoria (as appropriate), any of SP or Visit Victoria’s property which is in my possession or under my control.
